The short version
- Pick a pack or the taster on our website and pay at Stripe's secure checkout.
- We cook on Mondays and Thursdays. Order by Sunday 6pm for Monday, or by Wednesday 6pm for Thursday. Packs of 10 and 15 come in two halves, one on each day.
- Collect free from our kitchen, pick up free from a stockist once we have one, or get delivery within 20 miles of our kitchen for £2.50 or £4.00 a drop.
- Bowls keep for 3 days, counting the day they're cooked. Keep them at 0–5°C.
- Our kitchen handles all 14 major allergens. Check the label every time.
- You can cancel for a full refund until the cut-off for your first cook day. After that we've bought your food, so we can't.
- If anything's wrong with a bowl, tell us by its use-by date and we'll refund or replace it.
This summary doesn't replace the terms below.
1. About us
- We're Forty Grams Ltd, a company registered in England and Wales, company number [company number].
- Our registered office is [registered office].
- Email: hello@40grams.co.uk. Phone: [phone number].
- "We", "us" and "our" mean Forty Grams Ltd. "You" means the person placing the order.
These terms are for people buying for themselves. If you're buying for a business, see section 20. You must be 18 or over to order.
2. How to order, and when the contract starts
- Choose a pack or the taster on our website and press "Order now". This opens Stripe's secure checkout.
- At checkout, tell us which bowls you want, choose your cook day if you're ordering the taster or 5 bowls, choose how you'll get your bowls, and enter your details. You can check and correct everything before you pay.
- Tick the box to agree to these terms, then pay. Stripe takes your payment and emails you a receipt. That receipt is your order confirmation, and the contract between us starts when it's sent.
- We'll only get in touch before your cook day if we need something from you, for example to check your delivery address.
If we can't supply your order, for example because your address is more than 20 miles from our kitchen, we'll contact you and refund you in full.
Please keep your receipt, and save or print a copy of these terms. We keep a record of your order. Orders are made in English.
3. Prices and packs
Our prices include any VAT that applies. Delivery is extra, and you'll see it at checkout before you pay.
| What you can order | Price | Per bowl |
|---|---|---|
| 5 bowls | £40.00 | £8.00 |
| 10 bowls | £72.50 | £7.25 |
| 15 bowls | £97.50 | £6.50 |
| Taster: 3 bowls, one of each, first orders only | £24.00 | £8.00 |
| Extra bowls, added at checkout to a pack of 5, 10 or 15 (up to 4) | £9.00 each | £9.00 |
| The 100, once it's available | £14.00 each |
- Packs can be any mix of our bowls.
- Your smallest order is a 5-bowl pack, or the taster on your first order.
- There's no subscription. Order when you like.
- If we've made an obvious mistake with a price, we'll tell you before we cook your order. You can then pay the right price or cancel for a full refund.
- Our prices may change, but a change won't affect an order you've already paid for.
4. The taster
- The taster is 3 bowls, one of each of our bowls, for £24.00.
- It's for first orders only, and one per household. A household is everyone at the same delivery or collection address.
- It can't be used with a trainer's code, and you can't add extra bowls to it.
- If a taster turns out not to be your household's first order, we may cancel it before it's cooked and refund you in full.
5. The 100
Once it's available, The 100 is a large bowl with about 100 g of protein, worked out from its recipe. It costs £14.00. You can add up to 10 to any online order. It isn't part of the pack prices and isn't sold in stockists' fridges.
6. Trainer's codes
- If a registered personal trainer gave you their code, you can use it once, on your first order of £40 or more, for £5 off. It's one code per customer.
- A code can't be used on the taster.
- Checkout can't tell whether it's your first order, so we check by email address and delivery address. If a code is used on an order that isn't your first, we may cancel that order before it's cooked and refund it in full. You can then order again without the code.
- When you use a code, your orders for the next 12 months are linked to that trainer, who earns 50p for each bowl. It costs you nothing extra. Trainers see totals of bowls and money only, never your name or details.
- Codes work on online orders only, not on bowls bought from a stockist's fridge.
7. Cook days and order cut-offs
We cook twice a week.
| Cook day | Order by | Collected or delivered | Use by |
|---|---|---|---|
| Monday | Sunday 6pm | Monday evening | Wednesday |
| Thursday | Wednesday 6pm | Thursday evening | Saturday |
- Taster and 5-bowl orders come on one cook day. You choose Monday or Thursday at checkout, and we cook your bowls on the next one of those days whose cut-off you've made.
- 10- and 15-bowl orders always come in two halves, one on a Monday and one on a Thursday, whether we deliver them or you collect them. The first half comes on the next cook day whose cut-off you've made, so no bowl waits past its use-by date.
- If we have to close on a cook day, for example on a bank holiday, we'll say so on our website. If it affects your order, we'll offer you the next cook day or a full refund.
8. Collecting from our kitchen
- Collection is free. You'll see the kitchen's address when you choose collection at checkout.
- Collect your bowls on your cook day between [time] and [time]. Bring your order number. For 10 or 15 bowls, collect each half on its own cook day.
- If you can't make it, tell us before [time] on your cook day. We'll keep your bowls chilled for you to collect by [time] the next day.
- If your bowls aren't collected by then, we can't keep them or refund them, because they were cooked for you and won't keep. This doesn't apply if the delay was our fault.
9. Delivery
We deliver only within 20 miles of our kitchen by road. Delivery is charged for each drop.
| Distance from our kitchen | One drop (taster or 5 bowls) | Two drops (10 or 15 bowls) |
|---|---|---|
| Up to 10 miles | £2.50 | £5.00 |
| 10 to 20 miles | £4.00 | £8.00 |
- You choose your delivery zone at checkout, and we check every address.
- If your address is more than 20 miles from our kitchen, we'll contact you, cancel the order and refund everything, including delivery.
- If you chose the wrong zone, we'll contact you. You can pay the difference through a payment link we'll send you, or we'll cancel and refund you in full. If you paid for a further zone than you needed, we'll refund the difference.
- We deliver on your cook day between [time] and [time]. Your bowls travel chilled in cool boxes. Put them in your fridge as soon as you get them.
- The bowls become yours, and your responsibility, when they're handed to you or someone at your address, or left in a safe place you asked for.
10. If we can't deliver
- Someone needs to be in to take your bowls. If you'd like us to leave them somewhere safe if you're out, say so in the delivery notes at checkout. Once they're left there, they're your responsibility, so get them into a fridge within 2 hours.
- If nobody's in and you haven't given us a safe place, we'll call you. If we still can't hand them over, we'll take them back to the kitchen, and you can collect them there for free by [time] the next day.
- If they're not collected by then, we can't deliver them again for free or refund them, because they won't keep.
- If we miss your delivery because of something on our side, we'll deliver again for free or refund you, whichever you prefer.
11. Picking up from a stockist
Once our first gym or shop is stocking our bowls, you'll be able to choose it as a free pickup point at checkout.
- We'll put your bowls in their fridge on your cook day by [time], in a bag with your first name and order number.
- Collect them during the stockist's opening hours by [time] the next day. Ask at the desk if the fridge is locked.
- Once we've put your bowls in the stockist's fridge, they're your responsibility.
- Bowls left after that time come back to us and can't be refunded.
12. Use-by dates and storage
- Each bowl's use-by date is 3 days after it's cooked, counting the cook day. A bowl cooked on Monday is used by Wednesday. The date is on the label.
- Keep your bowls in the fridge at 0–5°C. Put them in as soon as you get them.
- Don't eat a bowl after its use-by date, even if it looks and smells fine.
- Eat it cold, or heat it as the label says. Our food information page has more detail.
13. Allergens
- The allergens in every bowl are listed on our website before you order, and in bold on every label.
- Our kitchen handles all 14 major allergens, including peanuts and tree nuts, so we can't promise that any bowl is free from any allergen.
- Check the label every time, even on a bowl you've had before, because recipes and suppliers can change.
- If you have an allergy, email us before you order. We can't change our recipes for allergies.
14. Cancelling an order
Your legal right to cancel
The law usually gives you 14 days to cancel an online order. That right doesn't apply to our bowls, because they're cooked to order and go off quickly (regulation 28(1)(c) of the Consumer Contracts Regulations 2013). This doesn't affect your rights if something is wrong with your order (section 15).
Our own cancellation policy
- You can cancel any order for a full refund until the cut-off for its first cook day: Sunday 6pm for a Monday cook, or Wednesday 6pm for a Thursday cook. Email hello@40grams.co.uk.
- After that cut-off we've bought the food for your order, so we can't cancel or refund it.
- If something comes up, email us and we'll try to help, for example by moving the second half of a 10- or 15-bowl order to a later cook day.
When we might cancel
We may cancel an order and refund it in full if:
- your address is more than 20 miles from our kitchen;
- a taster or trainer's code isn't on a first order (sections 4 and 6);
- we can't cook because of something outside our control, a problem in the kitchen or a shortage of ingredients; or
- we have good reason to think the order is fraudulent.
We'll tell you as soon as we can. Any refund is made within 14 days to the card you paid with.
15. If something's wrong with your order
By law, our bowls must be as described, of satisfactory quality and fit for purpose (the Consumer Rights Act 2015).
- If a bowl is faulty, damaged, missing or not what you ordered, tell us as soon as you can, and by its use-by date at the latest. Email hello@40grams.co.uk. A photo of the bowl and its label helps.
- You can choose a full refund for that bowl, or a replacement on your next cook day. If the whole drop went wrong, we'll refund its delivery charge too.
- Your legal right to reject a faulty bowl for a full refund lasts until its use-by date, because a bowl is expected to go off after that.
- We'll refund you within 14 days of agreeing you're due a refund, to the card you paid with, and we won't charge a fee. Card refunds usually take 5 to 10 working days to reach your account.
- If you think a bowl made you ill, tell us straight away. Keep any leftover bowl and its label in the fridge. We'll look into it. You can also report it to your local council's food safety team.
For free advice about your rights, contact Citizens Advice at citizensadvice.org.uk or on 0808 223 1133.
16. Complaints
Email hello@40grams.co.uk. We'll reply within 2 working days and aim to sort things out within 14 days. If you're not happy with our final answer, Citizens Advice can help (section 15).
17. Paying
- You pay in full when you order, through Stripe. You can pay by debit or credit card, or any other way shown at checkout.
- Your bank statement will show "FORTY GRAMS".
- Stripe handles your card details. We never see your full card number.
- Refunds go back to the card or account you paid with.
18. Our responsibility to you
- If we break these terms or are careless, we're responsible for loss or damage you suffer that's a foreseeable result. Loss is foreseeable if it's obvious it will happen, or if we both knew it might happen when you ordered.
- We don't exclude or limit our responsibility where the law doesn't allow it. That includes death or personal injury caused by our negligence, or that of the people who work for us, fraud, and your legal rights as a consumer, such as bowls being as described and of satisfactory quality.
- We're not responsible for loss we couldn't have foreseen, or for business losses: we sell to people for their own use.
- We're not responsible for harm caused by eating a bowl after its use-by date, by not storing or heating it as the label says, or by an allergen that's listed on its label.
- If something outside our control, such as severe weather, a power cut or illness, delays or stops your order, we'll tell you as soon as we can and refund anything we can't supply.
19. Your information
We use your personal information as our privacy policy explains.
20. Other terms
- Changes to these terms. We may update these terms. The version on our website when you order is the one that applies to that order.
- Passing on this contract. We may pass our rights and duties under these terms to another business. We'll tell you if we do, and it won't reduce your rights. You need our agreement to pass on yours.
- Nobody else has rights under this contract.
- If a court finds part of these terms invalid, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- Business customers. If you're buying for a business, the consumer rights in these terms don't apply to you. Our total responsibility to you is limited to the price of your order, and we're not responsible for loss of profit or business.
21. Which law applies
These terms are governed by the law of England and Wales. You can take legal action in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also take action in your local courts.
